1. Introduction

These Terms of Use ("Terms") govern your access to and use of BaxSim, the travel eSIM service, including our website, mobile applications, customer dashboard, and related offerings (collectively, the "Service"). BaxSim is the commercial brand name of the Service.

The Service is operated by BAXPAY SARL, Société immatriculée au R.C.S. Lille Métropole sous le numéro: 979498706, with registered office at 679 Avenue de la République, 59800 Lille, France ("BAXPAY", "we", "us", or "our").

By creating an account, purchasing an eSIM, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

BaxSim provides digital travel connectivity products, including prepaid and subscription-based eSIM data plans for use in supported countries and regions. BaxSim is a reseller of mobile data connectivity; network coverage, speeds, and availability are provided by third-party mobile network operators and may vary by location, device, and local conditions.

We may update plan catalogues, pricing, supported destinations, and features at any time. Displayed prices at checkout are binding for that transaction unless an obvious error occurred.

3. Eligibility and accounts

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate registration information and to keep your account details up to date. We may suspend or terminate accounts that contain false information or are used in violation of these Terms.

4. Orders, pricing, and payment

When you place an order, you make an offer to purchase the selected eSIM plan. A contract is formed when we confirm the order and make the eSIM available in your account.

Prices are shown in the currency you select at checkout. Taxes, duties, or payment-method fees may apply where required by law. Payments are processed by third-party payment providers (including Stripe). BaxSim does not store full payment card numbers.

Promotional codes, account credits, and referral rewards are subject to their specific rules, expiry dates, and eligibility requirements. We may refuse or revoke benefits obtained through misuse or fraud.

5. eSIM delivery, activation, and use

After a successful purchase, your eSIM profile and installation instructions are made available in the Service. You are responsible for verifying that your device is eSIM-compatible and carrier-unlocked before purchase.

Data allowances, validity periods, and fair-use rules are defined by the plan you purchase. Unused data generally does not roll over unless explicitly stated. Activation may require a stable internet connection and correct device settings.

You must not resell, sublicense, reverse engineer, or tamper with eSIM profiles except as permitted by law. You are responsible for compliance with local telecommunications regulations in countries where you use the Service.

6. Refunds and cancellations

Because eSIM profiles are digital goods that can be delivered instantly, refunds are limited once an eSIM has been installed, activated, or used (including any mobile data consumption). In those cases, wholesale connectivity has already been supplied and a refund is generally not available, except where required by applicable consumer law or where we verify a service failure attributable to BaxSim or our suppliers.

To request a refund, you must contact BaxSim support before disputing the charge with your bank. You can reach us via in-app support chat (signed in) or by email at [email protected]. Include your order number so we can review eligibility quickly.

The following situations may qualify for a refund when the eSIM has not been installed or used:

• You purchased a plan by mistake and the eSIM profile has not been installed or activated.
• Provisioning failed and no usable eSIM was delivered, or the order remained incomplete despite successful payment.
• You have not consumed any mobile data and the profile is still unused at our connectivity provider.
• Duplicate charges or obvious checkout errors verified by our team.

Eligible refunds are normally processed to your original payment method within a few business days. If you report a verified service failure after activation, we may, at our discretion, offer a replacement plan, account credit, or partial refund.

Filing a payment card chargeback after service was delivered may result in suspension of your account and eSIM profiles while the dispute is investigated.

Subscription plans renew automatically until cancelled in your account. You may cancel renewal at any time before the next billing date; cancellation stops future charges but does not entitle you to a refund for the current billing period unless required by law.

7. Acceptable use

We may investigate suspected violations and cooperate with law enforcement where required. Violations may result in suspension, termination, and forfeiture of unused balances.

• Use the Service only for lawful personal or internal business travel connectivity.
• Do not use the Service for spam, bulk unsolicited messaging, denial-of-service activity, or illegal content distribution.
• Do not attempt to circumvent usage limits, billing, security controls, or geographic restrictions.
• Do not misrepresent your identity or payment authorization.

8. Intellectual property

The Service, including software, branding, text, and design, is owned by BAXPAY or its licensors and protected by intellectual property laws. BaxSim is a product brand of BAXPAY. These Terms do not grant you any ownership rights.

You may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, BAXPAY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted connectivity, specific network speeds, or compatibility with every device or carrier configuration.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BAXPAY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID TO BAXPAY FOR THE RELEVANT ORDER IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) EUR €50, EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.

11. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms, create risk for us or other users, or where required by law or payment partners.

Provisions that by their nature should survive termination (including payment obligations, disclaimers, and limitations of liability) will survive.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use after changes become effective constitutes acceptance, except where your consent is required by law.

13. Governing law and disputes

These Terms are governed by the laws of France, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence provide otherwise.

If you are a consumer in the European Union or United Kingdom, you may also have the right to use the European Online Dispute Resolution platform or local consumer dispute mechanisms.
